1. Acceptance of Terms

By accessing or using GetIntent ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. You must be at least 18 years old to use GetIntent.

2. Description of Service

GetIntent provides an AI-powered landing page personalization service that dynamically transforms website content based on visitor intent and traffic source. The Service is designed for businesses that want to tailor their website messaging to different audiences automatically. We provide tools for:

• AI-generated content personalization based on visitor signals
• Analytics, conversion tracking, and performance insights
• A/B testing and experimentation
• Brand voice configuration for consistent AI output
• UTM link building and traffic source management
• API access for custom integrations

3. Account Registration

To use our Service, you must create an account and provide accurate information. You may register using email or through third-party authentication providers (Google, GitHub). You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access.

4. Payment Terms

The Service is offered in multiple tiers (Free, Starter, Pro, Scale, Enterprise) with varying features and usage limits. Current pricing is displayed on our website. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

Each plan includes a monthly limit of AI personalizations. If you exceed your limit, cached content will continue to be served but new personalizations will be paused until the next billing cycle or you upgrade your plan.

5. Acceptable Use

GetIntent is built for personalizing your own website content for legitimate business purposes. You agree NOT to use the Service to:

• Generate content that is illegal, harmful, or violates third-party rights
• Create misleading, deceptive, or fraudulent content
• Personalize pages with spam, malware, or phishing content
• Circumvent usage limits or security measures
• Reverse engineer, decompile, or copy the Service
• Resell or redistribute the Service without authorization
• Collect or process personal data in violation of applicable privacy laws
• Use the Service for any purpose that violates applicable laws or regulations

6. Data Processing and Privacy

6.1 Visitor Data

To provide personalization, the Service processes information about your website visitors, including UTM parameters, page URLs, browser information, and anonymized identifiers. We do not sell visitor data to third parties. Visitor data is used solely to deliver and improve the personalization service.

6.2 Your Obligations

You are responsible for ensuring that your use of GetIntent complies with applicable privacy laws, including GDPR, CCPA, and other data protection regulations. This includes providing appropriate privacy notices and obtaining necessary consents from your website visitors for data collection and personalization.

6.3 Data Hosting

All data is hosted on infrastructure located in the European Union.

6.4 Data Retention

Analytics data is retained for 90 days by default. Account data is retained for the duration of your account. Upon account termination, your data will be deleted within 30 days, unless retention is required by law.

7. AI-Generated Content

7.1 Content Ownership

AI-generated content produced by the Service is provided for your use on your website. You are granted a perpetual, non-exclusive license to use, modify, and publish AI-generated content created through your account.

7.2 Your Responsibility

While we strive to generate high-quality, brand-appropriate content, you are responsible for reviewing AI-generated content displayed on your website. We do not guarantee that AI-generated content will be error-free, factually accurate, or suitable for any particular purpose.

7.3 Training Data

We do not use your content, brand guidelines, or AI-generated output to train AI models. Your data is processed only to deliver personalization results for your account.

8. Intellectual Property

The Service, including its design, software, algorithms, and documentation, is owned by GetIntent and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks or branding.

You retain ownership of content you provide to the Service, including brand guidelines, original text, and website content. You grant us a limited license to use this content solely to provide the Service.

9. Third-Party Services

The Service integrates with third-party providers to deliver its functionality, including payment processing (Stripe), authentication (Google, GitHub), AI model providers, and hosting infrastructure. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.

10. Service Level

We strive to maintain high availability for the Service. While we aim to provide continuous service, we are not liable for any delays, failures, or interruptions in service beyond our reasonable control. Cached content will continue to be served to your visitors even during periods of service disruption.

11. Limitation of Liability

To the maximum extent permitted by law, GetIntent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amounts paid by you in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless GetIntent and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, the content displayed on your website through the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account for violation of these terms or for any other reason at our discretion. You may cancel your account at any time through your dashboard settings. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of account termination by contacting support.

14. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, or failures of third-party service providers.

15. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
